Terms & Conditions
A. Honey Creations, LLC is my Limited Liability Company where Amanda Honeywell is an independent freelancer. Amanda is an art director, marketing manager and a visual communicator who utilizes her skills in graphic design and photography. A. Honey Creations, LLC does business as Hillsdale Web Design where Amanda also utilizes her skills as a visual communicator through UX design.
The Contractors the Owner suggests the Customer take advantage of are housed under a second DBA with A. Honey Creations, LLC called Hillsdale Marketing Group. Hillsdale Marketing Group does not have a bank account and does not accept or disperse money in any way. It is simply a brand name used to showcase a group of specialized Contractors who all share a common goal and who all agree to be managed and represented by HMG or the Owner.
A. Honey Creations, LLC, Hillsdale Web Design and Hillsdale Marketing Group will from hereon be known as “HMG”. Amanda Honeywell will be known hereon as the “Owner”.
Customer: A client, consumer, business owner, manager, or business representative hiring HMG to complete Deliverables.
Contractor: Individuals and/or companies independently contracted and not employed by HMG. Contractor companies or its licensors, suppliers, vendors, officers, directors, members, managers, employees, Contractors or Subcontractors or agents, creative professionals as well as information technology specialists, all hired by HMG to perform Deliverables for the Customer.
Agreement: A document that states clearly what the Deliverables are to be provided to the Customer that both parties agree to and the Customer agrees to pay in full once HMG completes the Deliverables to satisfaction. The agreements will be governed by and legally bound.
Deliverables: Completed services, products, projects, files, materials, etc.
Deliverable Tools: Necessary functions being labored skills and/or the use of programs, software, platforms, etc. by HMG and/or independent Contractors.
Media: Images, typography, videos and creative composition, information, data, text, photographs, graphics, messages or other material.
Camera Ready: Media that is 100% ready to use provided by the Customer to HMG.
As an art director, the Owner supervises the responsibilities for marketing decisions of the Customer’s brand. As a marketing manager, the Owner helps the Customer manage a team of Contractors they hire to assist in their online presence and marketing efforts. As a visual communicator, the Owner is also responsible for the layout and the ‘look and feel’ of the Customer’s printing materials, website, and online marketing efforts.
The Owner focuses on evaluating and improving user experience. The Owner helps manage customer outreach through marketing. The Owner assists in obtaining and managing media for the Customer to ensure a cohesive brand message and effective marketing plan.
The Customer recruits HMG as an independent Contractor and can take advantage of the tools suggested in assisting in their business goals. The Owner sees to it that the Deliverables provided as well as the Deliverables other Contractors the Customer hires (under the Owner’s direction or management), are performed in a professional and skillful manner and in accordance with industry standards.
The Owner’s Customers understand that the Owner is only responsible for directing and managing their marketing plan and providing graphic, photography and UX design and that everything else suggested to utilize Contractor’s offerings are not employees of HMG or the Owner.
The Contractors are able to, and do, offer their services outside of HMG as they, as stated, are not employees and can come and go and do as they please.
The Owner provides exact details of who, where, and what HMG’s suggestions are to the Customer. The Owner also provides the Customer detailed sales receipts of what all costs are. The Owner asks that the Customer sign-off prior to orders being placed with HMG so that the Customer fully understands that the Owner is not liable for errors, breaches, mistakes, etc. should they arise. The Customer understands that while the Owner is invoicing them resold items through HMG of all Contractors and that the price for upselling is used towards paying the Owner to direct and manage the services and products the Contractors offer, that the Owner in no way takes responsibility for these Contractor's Terms and Conditions or Agreements.
Offering Customers one (1) invoice they can pay for all of their needs, provides the Customer peace of mind knowing all of their Deliverable Tools are being paid for one time and appropriately as the Owner ensures they are getting the best possible rates. Managing and directing the Customer's Contractor’s services and products also provides the Customer peace of mind knowing that a professional is handling everything they need from start to finish.
The Owner gives the Customer a clear understanding of what all costs are and what programs, software, companies and Contractors HMG uses so that the Customer can make executive decisions and know 100% what they are paying for. Customers do not have to use the Owner suggestions. They could go directly to the source, even. However, if a Customer decides to use their own provider or pay directly to a provider, the Owner does not offer direction or management of, including understanding billing or policies of these Contractors. In this situation, the Owner would only offer visual communication services (graphic design, photography and UX design) and the Customer would be solely responsible for their own payments of invoices and Terms and Conditions for whoever they work with outside of HMG’s suggestions and the Owners direction and management offerings.
